PLYMOUTH — A Plymouth County prosecutor asked jurors Tuesday to imagine Robert McKenna’s final moments, alone and bleeding to death in his underwear on the floor of his kitchen, as they begin deliberations today in the trial of one of the men accused of his murder.

Assistant District Attorney Christine Kiggen painted the grisly picture for jurors Tuesday as she and a defense attorney delivered their closing arguments in the murder trial of Michael Moscaritolo, a Quincy lawyer accused of orchestrating a botched burglary that left McKenna dead in a pool of blood on his kitchen floor in 2015. Kiggen said Moscaritolo was the one who devised the heist and recruited a team to carry it out, but Moscaritolo’s attorney argued throughout the two-week trial that prosecutors had little evidence showing that he was actually at McKenna’s home when he was attacked and left for dead.

Prosecutors say that Moscaritolo and two other men, Mark O’Brien of South Boston and James W. Ferguson of Stoneham, broke into McKenna’s home at 190 Damons Point Road home to steal his collection of guns and African art, as well as marijuana from his secret grow operation. Enlarge Image Jacobi Medical Center A Bronx family’s babysitter was busted for flying into a fit of rage and stabbing her employer in front of the kids during an argument over payment, police said Tuesday.

“I don’t work for free!” Miriam Paloma shouted as she fought with the 27-year-old mother of two children, ages 4 and 7, according to authorities.

The home aide cares for one of the two children, who has special needs, a police source added.

She then plunged a knife into the woman’s shoulder twice and slashed her once in the right side — in front of both children, police said.

The victim was taken to Jacobi Medical Center with non-life-threatening injuries, cops said. The children were not hurt.Paloma, who is also 27, was arrested soon after and charged with assault, acting in a manner injurious to a child, menacing and criminal possession of a weapon. She has no prior arrests.

Veta Lewis Even the mother of convicted Queens killer Chanel Lewis was moved by the statement from his victim’s mom in court Tuesday.

While insisting her son is innocent of jogger Karina Vetrano’s murder, “I give condolences to the family, because I am a mother, and it broke my heart when [Karina’s mom Cathie Vetrano] talked today because I feel the mother’s pain. … The mother will never see her daughter,” said Lewis’s mom, Veta Lewis.

Veta made the comments outside Queens Supreme Court after 22-year-old Chanel was sentenced to life in prison without parole .

Vetrano’s mom had delivered her statement in court ahead of the sentencing, calling her daughter’s killer “a pathetic evil coward” who made her family suffer and die “one million deaths.”

Still, Veta professed her son’s innocence.

“Judge [Michael] Aloise sentenced my son, but I want to say to the judge he sent an innocent man to prison,” Veta said.“As a mother I still believe, and I know, my son Chanel is innocent. Chanel did not kill this lady,” she said. “The judge tried to sentence him without compassion. … What he did today was not justice for Chanel.”Veta claimed that “everything was framed” by Queens Assistant District Attorney […]

Sex offender busted for allegedly groping teen girl on subway

Jesus Ayala is led away by police Tuesday night. A sex offender was busted Tuesday after he allegedly groped a 14-year-old girl — and tried to grind on her — in plain view of cops, police sources told The Post.

Jesus Ayala, 64, allegedly preyed on the young girl aboard a northbound No. 1 train between 59th Street and 66th Street at about 3:45 p.m., cops said.

Cops say he put his hands on her thighs and tried to rub against her body before NYPD transit officers stepped in and arrested him as the teenager was trying to get away.

They brought Ayala — a registered sex offender who is on parole — to a police station in the Columbus Circle train station, where he admitted to the crime, police sources said.

“He actually confessed,” a police source told The Post.

Ayala, who is from Connecticut, was hit with sexual abuse and acting in a manner injurious to a child charges, cops said. Keeping sex offenders off the subway is a constant struggle for the NYPD because the most common subway sex crimes — including forcible touching, persistent sexual abuse and public lewdness — are misdemeanors that carry little or no jail time for […]

SKOWHEGAN — Assistant Attorney General Lara Nomani on Tuesday opened the second day of the appeal hearing of convicted killer Jay Mercier with cross examination of the trial attorney who represented the man.

Nomani sought to counter attorney Amy Fairfield’s assertion that Mercier did not get a fair trial in 2012 because of the ineffectiveness of his defense team, led by attorney John Alsop. She later called to the stand Alsop’s co-counsel in the Mercier trial, John Martin, now a district court judge, and Andrew Benson, also now a judge, who was the lead prosecutor in the murder trial in 2012.

Mercier, now 63, was found guilty of murder in the 1980 death of Rita St. Peter after prosecutors used DNA from a cigarette butt to match samples taken from the victim 32 years before. Alleged bigamist, formerly of Maine, to plead guilty in New Hampshire

A former Maine man with a history of domestic violence charges is expected to plead guilty and be sentenced Friday in New Hampshire on the unusual charge of bigamy.

Michael Middleton, 43, most recently of Old Orchard Beach, faces between 3 and 1/2 to 7 years in prison on the class B felony charge, according to David Rotman, assistant Strafford County attorney.

Court documents allege that Middleton was married to at least two other women – Katherine Lashley in Georgia in 2006 and Kassandra Shipley in Alabama in 2011 – when he married Alicia Grant in Dover, New Hampshire in 2013.

Middleton would later marry another woman, Ashley Climer, in Kentucky in 2016, without divorcing his prior wives.

He was indicted by a grand jury in New Hampshire in January on the bigamy charge but failed to appear for his arraignment. He was arrested in Ohio a month later after police received an anonymous tip and extradited him back to New Hampshire.

ALFRED — The woman on the witness stand in York County Superior Court pulled her red cardigan tighter around her.

Defense attorney Neal Weinstein was questioning her about her accusations that a former guard sexually assaulted her multiple times while she was incarcerated at a women’s transitional facility in Alfred. She had already spent hours Tuesday testifying about their alleged sexual encounters in a prison transport van, which he used to drive her between the facility and her job at a pizza dough manufacturer or her classes at a community college.

“Did you flirt with him?” Weinstein asked. “Is that why this event happened?”

“Are you asking, did I ask for it?” she answered. “No.”

“I’m asking, were you flirting with him when he picked you up?” Weinstein asked.

“No,” she answered.“Did you tell him, ‘Are you crazy, what are you doing? WHITE RIVER JUNCTION — A 46-year-old Barnard man who has served four years in jail while awaiting trial in a sexual assault case pleaded guilty on Tuesday to felony lewd and lascivious conduct with a child.

Gregory Clasby changed his plea in Windsor Superior Court in White River Junction and returned to Southern State Correctional Facility in Springfield, Vt., until his sentencing later this year.

Clasby, a professional blacksmith who moved to the Upper Valley from New York in 2009, had been fighting his case but decided to take a plea deal, he told Judge Timothy Tomasi on Tuesday.

“I apologize for everything taking as long as it has and for my part in that,” Clasby said. “I know I haven’t made this easy.”

Deputy Windsor County State’s Attorney Heidi Remick and Clasby’s attorney, Chris Montgomery, outlined the parameters of Clasby’s sentence at the hearing.His sentence will entail him serving a length of time that the Department of Corrections deems necessary for him to complete a recommended sex offender treatment program. Court papers detail creepy sex den allegedly used by Nxivm leader

Keith Raniere Nxivm’s accused cult leader had sex with “slaves’’ in a pal’s home library — which included a bed elevated over a hot tub, according to new court papers.

The creepy digs were detailed in grand-jury testimony from two women who said they had sexual relations with Keith Raniere in the second-floor study of a home at 8 Hale Drive in upstate Halfmoon. The house is owned by Nxivm co-founder Nancy Salzman.

“The bed was elevated, and a hot tub was underneath the bed,” a former Nxivm member, Mark Vicente, also testified, the papers say.

One of Raniere’s alleged slaves said she also had sex with the 58-year-old leader in the home of “Smallville” TV actress and high-ranking Nxivm member Allison Mack.

The library was where the feds found a hard drive containing child pornography and additional sexually explicit images of other Nxivm members, including bookkeeper Kathy Russell and accused DOS slave master, Lauren Salzman, prosecutors say.
